Terms of Service

Welcome to Gists. These terms are the agreement between you and Goadvert iAdvertise (Private) Limited ("we", "us"), a company registered in Zimbabwe, which runs the Gists website at gists.chat and the Gists apps. By creating an account or using Gists you agree to these terms, our Privacy Policy and our Community Guidelines.

1. Who can use Gists

• You must be 17 or older. We ask for your date of birth when you sign up and remove accounts that belong to anyone younger.
• People aged 17 get extra protections until they turn 18 (see Child Safety).
• You must give true details about yourself, keep one account per person (unless you run a separate account for a business or group), and not use Gists if we have removed you before.

2. Your account

• Keep your password safe and don't share your account. You are responsible for what happens on it.
• Tell us at [email protected] if you think someone else has got into your account.
• You can delete your account at any time in Settings. What happens to your information then is explained in the Privacy Policy.

3. Your content

Your Gists, photos, voice notes, comments, messages and profile ("your content") stay yours. To run Gists we need your permission to use them, so you give us a worldwide, non-exclusive, royalty-free licence to store, copy, resize, convert, show and send your content to the people you choose to share it with, only for running and improving Gists. This licence ends when you delete the content or your account, except for copies other people already received (for example messages in their chats) and backups that are cleared out on their normal schedule.

Only post what you have the right to share. If you post a photo or voice recording of someone else, make sure they are happy for you to share it.

4. Rules

Follow the Community Guidelines. In short, don't: harm or threaten anyone, post sexual content involving anyone under 18, harass or bully, share someone's private information, spam or scam, pretend to be someone else, break the law, or try to break, overload or get around the security of Gists.

5. Reporting, removal and suspension

• You can report a person, Gist, comment or message from its menu. We look at reports and may remove content, limit features or suspend or delete accounts that break these terms or the Guidelines, or when the law requires it.
• Where we can, we tell you why. If you think we got it wrong, write to [email protected] and we will look again.
• If you think content on Gists infringes your copyright, email us with the link, what you own and your contact details, and we will act on valid notices.

6. The service

Gists is free to use. We are always improving it, so features may change, be added or be taken away. We try hard to keep Gists running and your content safe, but we can't promise it will always be available or error-free, and we are not responsible for what other people post or send.

7. Liability

As far as the law allows, Gists is provided "as is", and we are not liable for indirect or unexpected losses, lost profits or lost data arising from your use of Gists. Nothing in these terms limits rights you have by law that cannot be limited.

8. Changes to these terms

If we change these terms in a way that matters, we will tell you on Gists or by email before the change takes effect. If you keep using Gists after that, the new terms apply.

9. Law

These terms are governed by the laws of Zimbabwe, and the courts of Zimbabwe deal with any dispute, unless the law where you live gives you the right to go to your local courts.
